These terms and conditions shall supersede any subsequent terms or conditions included with any purchase order, whether or not such terms or conditions are signed by azoressurfride.com
1- Ride with the Wave Azores Legal Entities
The Ride with the Wave Surf School Azores website www.azoressurfride.com is owned and operated by Tânia Arruda Laje herein referred to as Ride with the Wave Azores. We reserve the right to make changes to these sites and terms and conditions without notice.
2- Copyright
The text and illustrations (including photographs) used by Ride with the Wave are protected by copyright and must not be copied in whole or in part without the express permission of Tânia Arruda Laje.
3- Liability
Ride with the Wave Azores is not liable for any losses or damages caused by this website or any website linked to or from this website. We reserve the right to refuse any purchase without giving reason.
4- Copyright and Trademark Notice
This site is owned and operated by Ride with the Wave Surf School Azores Unless otherwise specified, all materials appearing on this site, including the text, site design, logos, graphics, icons, and images, as well as the selection, assembly and arrangement thereof, are the sole property of Tânia Arruda Laje. No materials from this site may be copied, reproduced, modified, republished, uploaded, posted, transmitted, or distributed in any form or by any means without Tânia Arruda Laje prior written permission. All rights not expressly granted herein are reserved. Any unauthorised use of the materials appearing on this site may violate copyright, trademark and other applicable laws and could result in criminal or civil penalties.

6- Prices
We reserve the right to change prices without notice. All prices include Services Tax at the current rate of 18% in the Azores Islands.
7- Surf Lessons Online Bookings
Lesson Availability
All surf lessons are offered subject to availability. Availability dates that can maybe be displayed on the website are guidelines only and are subject to change. We suggest if you plan to purchase a surf lesson for a date listed at short notice, you contact us to ensure there is still availability before completing the transaction.
8 – Surf Lessons
8.1- While using our equipment (wetsuit, leash and surfboard) the client agrees to use it with care. The Ride with the Wave Surf School Azores assumes no liability for any injury, damage, death, damages, losses or costs incurred by the customer and/or to third parties due to activities, error, negligence, offences, misconduct, omissions, failures, false information or any illegal false information attributable to our company. We include personal accident insurance in our surf lessons unless considered a case of neglect or misconduct. In cases of neglect or misconduct, the customer will be responsible for costs incurred in the repair or replacement of damaged equipment.
The following are considered cases of neglect or misconduct:
-Use of soft boards outside the white water area. Unless instructed by a qualified instructor.
-Use of hard boards in the white water area. Unless instructed by a qualified instructor.
– Walk or sit on the surfboard when upside down (fins faced upward).
– More than one person walking or sitting on the board simultaneously.
– Dragging of surfboard or wetsuit.
– Any damage caused to the equipment intentionally
– Failure to follow safety procedures and advice given by qualified on duty surf instructor.
9- Lesson Length
Lesson lengths are approximate and are given as a guide to the total lesson duration.
10- Equipment Rental
10.1- While using our equipment (wetsuit, rash vest and surfboard) the client agrees to use it with care. The Ride with the Wave Surf School Azores assumes no liability for any injury, death, damages, losses or costs incurred by the customer and/or to third parties due to activities, error, negligence, offences, misconduct, omissions, failures or any illegal false information attributable to our company. In the case of negligence or misconduct, the customer will be responsible for costs incurred in the repair or replacement of damaged material.
10.2- The following are considered cases of neglect or misconduct:
– Use of soft boards outside the white water area. Unless instructed by a qualified instructor.
-Use of hard boards in the white water area. Unless instructed by a qualified instructor.
-Walk or sit on the surfboard when upside down (fins faced upward).
-More than one person walking or sitting on the board simultaneously.
-Dragging of surfboard or wetsuit.
-Any damage caused to the equipment intentionally.
10.3 – Cancellations, Changes and Refunds:
10.4- Cancellations and Changes:
In case of cancellation, the customer will receive a credit for use in booking rental services supplied by us in the amount of:
• 100% refund if cancellation made 24 hours in advance of the scheduled start of service.
• 50% refund if cancellation made 12 hours in advance of the scheduled start of service.
• 0% if cancellation is not made 12 hours in advance of the scheduled start of service.
10.3.1 -Refunds:
Under the conditions of subparagraph 10.3, the appropriate Refunds will be made in the form of credit.
Refunds are not made in other forms of payment for equipment rental.
11- Contact Details
It is your responsibility to ensure you enter your email address and other contact details correctly when you complete the surf lesson booking process on the Ride with the Wave Azores website. Failure to do so may result in loss or incorrect delivery of the email confirmation of your reservation. As Ride with the Wave Azores will be expecting you to attend, you may end up forfeiting your lesson cost.
12- Booking Cancellations
12.1- Cancellations and Changes:
To confirm reservations we ask for a deposit of 30% of the total reservation.
In the event of cancellation, this value is not refunded. You can, however, use this value as a credit toward another reservation as long as the cancellation or amendment is made 20 days prior to the scheduled date of arrival to the surf lesson.
12.2 -Refunds:
The refund of 30% is in the form of credit towards future bookings. In case of cancellation after payment of the remaining 70% of the total booking, this will be refunded by bank transfer and all costs associated with this transaction are the customer’s responsibility, only if Ride with the Wave Azores is notified in 24h prior to the surf lesson. If cancellation is not made 24h in advance of the booking, client may lose the total 100% of payment, unless there is medical reasons for cancellation.
In the case of non-attendance by the client and failure to notify Ride with the Wave Azores, you may lose your lesson payment completely.
12.3 – If Ride with the Wave Azores needs to cancel a lesson for any reason, you will be notified as soon as possible in order to reschedule a convenient alternative date. Ride with the Wave Azores will not reimburse any traveling, accommodation or other expenses incurred by you or any other person in the event of a cancellation.
13-The Weather
Surf Lessons are weather dependent and your safety is a key factor in deciding on cancellation of the whole class If bad weather affects a booking it will be rescheduled at no additional cost to you. You are required to reschedule as the booking is non-refundable.
14-Complaints or Problems During Your Surf Lesson
If you have a problem or a complaint on the day of your Surf Lesson please bring this to the instructor’s attention immediately so that issues may be addressed on the spot, where possible.
15-Insurance
Participating in the surf lessons can be inherently dangerous. Participating in the surf lessons is entirely at your own risk. Ride with the Wave Surf School Azores only covers insurance for clients during the surf lessons at any situation that can cause injury to another individual, while clients are still in the water during the length of the surf lesson.
As per the Ride with the Wave Surf School Azores participation form you must agree to:
(a) Release and forever discharge Ride with the Wave Azores from all liability and Claims that you may have or may have had but for this release arising from or in connection with your participation in the surf lessons;
(b) Indemnify and hold harmless Ride with the Wave Azores to the extent permitted by law in respect of any Claim by any person including but not only another participant in the surf lessons arising as a result of or in connection with your participation in the surf lessons.
You must not participate in the surf lessons if you have any injury, disability, medical or health condition that may increase the risk of injury unless you have told Ride with the Wave Azores about it and they have authorised you to participate.
